Federal Court Mandates Release of Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without legal authority.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her ruling.
The situation stems from a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an mistake. After his repatriation to the United States to face human smuggling allegations, he was detained in federal custody.
In her order, the court pointed out that the government does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
Context of the Legal Challenge
The court proceedings involve disputed assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in the state of Tennessee.
Conditions of Release
The court, who was overseeing his challenge to removal in a federal court, ruled that he must now comply with the terms of his bond from custody in Tennessee. This decision shifts his supervision to the Tennessee court.
This ruling marks a notable development in a complicated legal battle involving allegations of mistaken imprisonment and disputed criminal affiliations.
